POLICY MANUAL -
Series 400 - Students

Policy #423 - Public School Open Enrollment

 

Beginning with the school year 1998-1999, the District Administrator shall determine the availability of openings for resident and non-resident students based on the established maximum or optimum number of students that can be accommodated in each school, class, or program.  The availability of space in the schools, programs, or classes may be based on class size limits or guidelines as the same may be developed or modified through contracts, board policy, or state administrative agencies, student-teacher ratios, students attending the District for whom tuition is paid under Wis. Stat. sec. 121.78(1)(a) or enrollment projections established by the Board.

 

I.    Non-Resident Open Enrollment Students

 

      A.  Full-Time Enrollment

 

            1.   Criteria for Acceptance or Rejection

 

                  a.   The district will give preference in accepting applications to any non-resident students already attending school in the district and their siblings.

 

                  b.   The district will consider the availability of space in the schools, programs, classes, or grades within the school district based on class size limits or guidelines as the same may be developed or modified through contracts, board policy, or state administrative agencies, student-teacher ratios, students attending the district for whom tuition is paid under Wis. Stat. 121.78(1)(a) or enrollment projections established by the Board.

 

                  c.   The district will not accept a student who has been expelled by a school district during the current school year or preceding two school years for conduct specified in the law or who has expulsion or other disciplinary proceedings pending based on such conduct.  “Conduct specified in the law” includes endangering the health, safety, or property of others under certain conditions, conveying or causing to be conveyed a bomb threat involving school property, and possessing a dangerous weapon as defined in Wis. Stat. sec. 939.22(10) while at school or under the supervision of school authorities.

 

                        If an expulsion or other disciplinary proceeding is commenced for any of the foregoing reasons after initial acceptance of the student and prior to the student starting school in the district, the district will deny the enrollment of the non-resident student.

 

                        Nothing shall prohibit the district from refusing to admit a student during the period of expulsion established by another school district or by this district regardless of the date on which that expulsion occurred.

 

                  d.   When considering the admission of a student with exceptional education needs, the district will consider whether the special education program or related services described in the student’s Individual Education Plan (IEP) are available in the district and whether there is space available in the special education program identified in the student’s IEP based on class size limits or guidelines as the same may be developed or modified through contracts, board policy or state administrative agencies, student-teacher ratios, students attending the District for whom tuition is paid under Wis. Stat. sec. 121.78(1)(a) or enrollment projections established by the board.

 

                  e.   If a non-resident student’s IEP changes after the student begins attending the district and the special education program or services required by the IEP are not available in the district or there is no space available in the special education program identified in the IEP, the district will discontinue allowing the student to attend school in the district.

 

                  f.    The district will give consideration to whether a student has been reported or identified as having possible EEN but not yet evaluated by an IEP team in the resident district.

 

                  g.   The district normally makes placement decisions for resident elementary students based on their school attendance areas.  The district will not give preference in attendance at a school, program, class or grade to students who live outside the school’s attendance area.

 

                  h.   The district will not accept more non-resident students for a particular grade or program than there are spaces available in the grade or program.  In the event more applications are received than there are spaces available, the district will determine which students to accept by random drawing.

 

            2.   Middle School and High School

 

                  Acceptance of a full-time non-resident student into the middle school or junior high school does not guarantee that such non-resident student will be able to take his or her first choice of all classes offered.  Criteria used in scheduling and class eligibility, including prerequisite requirements, will be the same for resident and non-resident students.

 

            3.   Re-Application Procedures

 

                  Once a non-resident student is accepted as an open enrollment student in the district, the district will not require the student to reapply for enrollment at any time.

 

            4.   Transportation Arrangements for Non-Resident Open Enrollment Students

 

                  The district will not provide transportation to non-resident students participating in the full-time open enrollment program except for EEN students if transportation is required in their IEP or is otherwise required to be provided by law.


 

      B.  Part-Time Enrollment

 

            1.   Criteria for Acceptance or Rejection of High School Student Applications to Attend a Course(s)

 

                  a.   The district will give preference in course attendance to residents of the district.

 

                  b.   The district will randomly determine which non-resident students will be accepted when there are more applicants than there are spaces available.

 

 

II.  Resident Open Enrollment Students

 

      A.  Full-Time Enrollment

 

            1.   Transfer Limitations

 

                  a.   The district will deny applications to attend another school district if costs of special education services required in the student’s IEP would place an undue financial burden on the resident district as provided under state law.

 

                  b.   If a resident student’s IEP changes after the student begins attending a non-resident school district and the costs of the special education program or services required by the IEP would place an undue financial burden on this district, the district will discontinue allowing the student to attend school in the non-resident district as provided under state law.

 

            2.   Transportation Arrangements for Resident Open Enrollment Students

 

                  The district will not provide transportation to resident students participating in the full-time open enrollment program.

 

      B.  Part-Time Enrollment

 

            1.   Criteria for Acceptance or Rejection

 

                  a.   Students may attend no more than two courses at any time in a non-resident school district under the law.  The district must reject an application to attend a course in another public school district if the course conflicts with the student’s IEP.

 

                  b.   The district will reject an application to attend a course in another public school district if the cost would impose an undue financial burden on the district as outlined in state law.

 

                  c.   The district will not accept a student who has been expelled by a school district during the current school year or preceding two school years for conduct specified in the law or who has expulsion or other disciplinary proceedings pending based on such conduct.  “Conduct specified in the law” includes endangering the health, safety, or property of others under certain conditions, conveying or causing to be conveyed a bomb threat involving school property, and possessing a dangerous weapon as defined in Wis.
