Gun Free Schools
No student shall possess or bring a firearm or destructive device onto school property.
Any student who is determined to have brought a firearm or destructive device to school shall be referred to the criminal justice or juvenile delinquency system. As required by Wis. Stat. sec. 120.13(1)(c)(2m), any student who is determined to have brought a gun to school will be expelled for a period of not less than one year. For purposes of this policy, school premises shall include all facilities and property under the control and/or supervision of the District including, but not limited to, school grounds, school buildings, recreation areas, field trips, buses and athletic sites. The expulsion requirement may be modified by the Board of Education on a case-by-case basis.
Gun means a firearm as defined in Section 921(a)(3) of Title 18 of the United States Code.
According to Section 921, the following are firearms:
Any type of weapon (including a starter gun) which will or is designed to, or may readily be converted to, expel a projectile by the action of an explosive; the frame or receiver of any such weapon; any firearm muffler or firearm silencer or any destructive device.
Any combination of parts either designed or intended for use in converting any device into any destructive device described in the immediately preceding paragraph, and from which a destructive device may be readily assembled.
Exceptions
This policy does not preclude classes such as hunter education courses, which may involve the handling or use of firearms, to be allowed on school grounds after normal school hours and/or weekends. Additionally, this policy does not preclude an assembly or special event, such as Veterans Day, or Civil War Days from being allowed under appropriate administrative supervision.
Other Weapons
No student shall possess or bring any weapon onto school premises.
Any student who is determined to have brought a weapon other than a firearm or destructive device as defined above to school shall be referred to the criminal justice or juvenile delinquency system and may be referred to the School Board for expulsion proceedings.
The term "weapon" for purposes of this policy means a device, instrument, material, or substance, animate or inanimate, that is used or intended to be used for, or is readily capable of, causing death or serious bodily injury, including, but not limited to knives, pellet or other air propelled guns, electric weapons and similar items. Examples of items that are considered dangerous weapons include, but are not limited to, firearms, knives, razors, martial arts equipment, and metal buckles.
Students of the River Valley School District must be aware of the fact that possession of firearms or other weapons will not be tolerated and will be reported to the police.
Law enforcement officers and the Superintendent of Schools/designee shall be contacted as soon as possible in any weapons situation.
The possession of firearms or any other dangerous weapon(s) taken from a student will be reported to the student's parents/guardians.
The following are two exceptions to this policy:
1. Weapons under the control of law enforcement personnel or by an individual in accordance with a contract entered into between a school and the individual or an employer of the individual are permitted;
2. Instructional equipment purchased by the District that could be considered under the board definition as a dangerous weapon will be secured and supervised by the appropriate classroom teacher at the direction of the building principal.
